In 2003, First Nations Development Institute (FNDI) issued its first report on predatory lending in Native communities. This second report expands upon its analysis, updating information on the prevalence of predatory practices and adding new information from more recent quantitative data sources. Since the Fund was created in 1994, its funding has varied from year to year. It reached its highest point in Fiscal Year 2001, with $118 million appropriated. This has since declined to $80 million in FY 2002, $75 million in FY 2003, $63 million in FY 2004, and an estimated $56 million in FY 2005.

The United States Government holds much of the land in Indian Country in trusts; land may be tribal trust, individual trust, or fee simple. Despite the fact that trusts are designed for the benefit of an individual or a tribe, they present difficulties for mortgage lenders in terms of foreclosure, liquidation, and other practices. Some of the Center?s efforts are focused on determining how to develop successful Individual Development Account (IDA) program in Native American communities. The Center is also involved in efforts to mitigate the lack of access to capital and basic financial services that plague Native American reservations through research on predatory lending, financial services, and financial literacy.
